These Terms and Conditions (“Terms”) govern your access to and use of theibnb.com and the related services (together, the “Platform”) operated by The IBNB (“The IBNB”, “we”, “us”, or “our”). By creating an account, listing a property, or booking a stay through the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
1. The IBNB’s Role
The IBNB provides an online marketplace that allows property owners and managers (“Hosts”) to list properties for short and long-term stays, and allows travelers (“Guests”) to search for and book those properties. The IBNB is not the owner, operator, or manager of any listed property, and is not a party to the rental agreement between a Host and a Guest. Hosts are solely responsible for the accuracy of their listings and for complying with applicable laws, including licensing, tax, and safety requirements.
2. Accounts
You must create an account to list a property or make a booking. You agree to provide accurate information, keep your login credentials secure, and notify us promptly of any unauthorized use of your account. You must be at least 18 years old to create an account.
3. Listings
Hosts are responsible for setting accurate descriptions, photos, pricing, availability, and house rules for their listings. The IBNB may remove or suspend a listing that violates these Terms, applicable law, or our content standards, at our reasonable discretion.
4. Bookings and Payments
When a Guest books a listing, a reservation contract is formed directly between the Host and the Guest, on the terms disclosed at the time of booking. Payments are processed through third-party payment providers. Service fees, cleaning fees, and taxes, where applicable, will be shown before you confirm a booking. Prices are listed in the currency shown on the Platform and may vary by location and season.
5. Cancellations and Refunds
Each listing displays the cancellation policy that applies to it, which is set by the Host. Please review the applicable cancellation policy before booking. Refunds, where due, are processed in accordance with that policy and our Cancellation & Refund Policy.
6. Guest and Host Conduct
Guests agree to treat listed properties with care, follow the house rules provided by the Host, and leave the property in the condition in which it was found. Hosts agree to provide the property as described and to treat Guests fairly and without unlawful discrimination. Harassment, discrimination, fraud, and property damage are strictly prohibited and may result in suspension or termination of your account.
7. Reviews
After a stay, Hosts and Guests may leave honest reviews of one another. Reviews must not contain false, defamatory, or abusive content. We may remove reviews that violate this rule or our content standards.
8. Fees
The IBNB charges service fees to Hosts and/or Guests for use of the Platform, as disclosed at the time of listing or booking. We may change our fees at any time, with notice provided before the change takes effect for new bookings.
9. Intellectual Property
The Platform, including its design, text, graphics, and logos, is owned by or licensed to The IBNB and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our permission. By posting content (such as listing photos or reviews), you grant The IBNB a non-exclusive, royalty-free license to display and distribute that content on the Platform.
10. Disclaimers and Limitation of Liability
The Platform is provided “as is” without warranties of any kind. The IBNB does not guarantee the accuracy of listings or the conduct of Hosts or Guests. To the fullest extent permitted by law, The IBNB is not liable for indirect, incidental, or consequential damages arising from your use of the Platform or any stay booked through it.
11. Termination
We may suspend or terminate your account if you violate these Terms or use the Platform in a way that could cause harm to us, other users, or third parties. You may close your account at any time by contacting us.
12. Changes to These Terms
We may update these Terms from time to time. We will post the revised version on this page with an updated “Last updated” date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
